Terms of Service

1. Acceptance of Terms
By accessing or using the web platform or mobile application provided by Whitby App LTD, you agree to be bound by these Terms of Service.
2. Physical Liability Waiver (The Explorer Clause)
Whitby App LTD provides digital guides, maps, and user-generated walking routes. By undertaking any walking trail, you acknowledge that navigating coastal paths, cliff-side routes, and historic streets carries inherent physical risks.
- All routes are undertaken entirely at your own risk.
- We make no warranties regarding the accuracy, safety, or accessibility of any trail, path, or location.
- You agree to remain aware of your physical surroundings, obey local signage, and not rely solely on the application screen while interacting with navigation features near traffic, water, or other hazards.
3. User-Generated Content (UGC), Events & Conduct
To maintain a safe and welcoming community, we enforce a strict zero-tolerance policy for objectionable content.
- Routes & Media: You may not publish routes, descriptions, or photos that are abusive, defamatory, illegal, sexually explicit, or infringe upon third-party copyrights. Authenticated users can map out custom trails, specify waypoint stops, set photos, and publish routes to the community feed.
- Event Creation: Users holding the Event Organiser role may create events linked to specific venues. These event submissions are routed to the designated venue's Manager or Owner for review and approval before being published to the chronological event feed.
- Moderation: We reserve the right to moderate, edit, or permanently remove any user-generated content at our sole discretion. Built-in moderation tools allow users to report content via flags directly within the app.
- Licensing: By publishing a route or photo, you grant Whitby App LTD a non-exclusive license to display and distribute that content across the platform.
4. Business Subscriptions, Staff Roles & Commercial Terms
For venue owners opting into our premium merchant tier, the following terms apply:
- Staff Roles: Venue Owners maintain full management of venue profiles and can delegate staff roster permissions by inviting Base Staff, Managers, and Co-Owners. Venue Managers and Co-Owners are authorized to add new vouchers and approve events submitted by Event Organisers. Base Staff are assigned to specific venues exclusively to access the in-app camera QR scanner to validate customer vouchers.
- Analytics: We supply anonymized foot-traffic metrics based on the average time spent at your venue to help measure conversion.
- Digital Vouchers: Premium-tier venues can create promotional offers with defined titles, descriptions, and custom terms. Tourists claim these offers to generate secure, single-use QR codes stored in their personal hub.
- Validation: Authorized venue staff must use the restricted in-app camera scanner to verify the legitimacy of customer QR codes, mark vouchers as redeemed, and log audit entries.
- Billing & Cancellation: The premium subscription is billed at £50 per month on an automated, recurring basis via Stripe. Subscriptions can be canceled at any time via your owner dashboard. Cancellation takes effect at the end of your current billing cycle. We do not provide pro-rated refunds for partial months.
- Platform Discretion: We reserve the right to revoke "Featured" status, demote a venue, or terminate a business account if the venue violates our community guidelines or engages in fraudulent voucher practices.
5. Account Termination
We reserve the right to suspend or terminate your access to the Whitby App at any time, without notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties.
